Prosecuted officially Kim Phat Real Estate and Viet Hung Phat

After a period of investigation, on October 25, Police Investigation Agency (PC46) Public Security of HCMC decided to prosecute about “misappropriation of property” for Real Estate Joint Stock Company Kim Phat and Viet Hung Phat Investment JSC.

These two enterprises have committed fraudulent activities in sales, signed some contracts brokerage, transfer real estate projects in many projects in Dong Nai and Long An.

Real Estate Kim Phat and Viet Hung Phat fraudulent activities in the process of organizing brokerage consulting and marketing real estate projects for customers to sign contracts. Instead of signing sales contracts in accordance with the law, these two companies have signed contracts to agree on conditions for transfer of land use rights, contracts on conditions for capital contribution to build houses and transfer land use rights, contracts on agreement on conditions for capital contribution of land use right transfer.

All contracts are contrary to the contract brokers signed with the project investors. After that, Kim Phat and Viet Hung Phat have collected money, appropriating assets of customers. PC46 has decided to prosecute criminal cases appropriated fraud. At present, PC46 has summoned the relevant subjects to serve the investigation.

From the middle of 2016 to date, many customers have signed contracts to transfer the land use rights with Kim Phat Company to purchase land in Dong Nai and Long An.

However, Kim Phat has changed the name of the project, raised the selling price of land and signed with clients the overlapping civil contracts to legalize the difference between VND80-300 million / base. It is worth mentioning, Kim Phat does not bill customers but only a receipt sheet.

The most tricked up was the project of The Gold Hill in Dong Nai, originated from Long Kim Phat, legal entity of Dat Xanh Group as the investor. Hundreds of people have been cheated for a long time; Many people come to Kim Phat’s office to complain about being threatened by strange objects.

Meanwhile, in March this year Viet Hung Phat Company also signed a contract with customers to contribute capital to receive the transfer of land use rights for the project in Dong Nai. Although customers have transferred money, Viet Hung Phat does not transfer legal documents to customers. When customers come to Viet Hung Phat to be threatened by strangers, assault.

It is worth mentioning, both Kim Phat and Viet Hung Phat are the couple named Cuong-Ngan as the representative before the law. Both Cuong and Ngan were born in 1986.
