Samco was checked for a series of land offenses

Ho Chi Minh City Inspectorate HCM has recently announced the city’s land use audit findings in 2018, of which the “roll call” of Sai Gon Transportation Engineering Corporation Limited (Samco) .

In Inspection Conclusion (04 / KLTTT-P6) on the comprehensive inspection of Saigon Transportation Engineering Corporation (SAMCO), the Inspector General has issued a series of violations on land use of this unit.

Samco was checked for a series of land offenses

Specifically, Samco did not use the land lease contract and the land use right certificate for two sites at 1 Ha Noi Highway, Hiep Phu Ward, District 9 and 444-448 Nguyen Chi Thanh, ward 6, district 10. This violates the provisions of Clause 1, Article 170 of the Land Law 2013 stipulating general obligations of land users is to use land for the right purpose.

Samco is also identified for subcontractors and has not sought the opinion of the City People’s Committee. Ho Chi Minh City for the three ground houses 1450 Vo Van Kiet, Ward 1, District 6; 444-448 Nguyen Chi Thanh Street, Ward 6, District 10; No. 1135 National Road 1A, Quarter 5, Tan Tao Ward, Binh Tan District. This is in violation of the provisions of Article 175 of the Land Law 2013, which stipulates the rights and obligations of land lease organizations that sign annual land lease contracts and do not have the right to lease land (land).

In addition, Samco does not carry out procedures related to the use and exploitation of the ground at 264 Tran Hung Dao street, Nguyen Cu Trinh ward, district 1 – improperly implemented by the People’s Committee at the certificate  Investment number 411022000718 certified for the first time on June 24, 2013.

It is known that the Office of HCM City People’s Committee has written (325 TP-VP) agreed basically with the contents of the inspection.

The city assigned the chairman of the Samco Council (currently Mr. Nguyen Hong Anh) and the General Director (now Mr. Tran Quoc Toan) to review, clarify personal responsibility of the relevant period for the wrong In the case of advising, proposing, inspecting and supervising the lease of land and premises as well as other errors.
