Congress amend and supplement the Land Law in 2019

In 2019, the National Assembly plans to pass 6 bills, 1 resolution and 9 other bills at the mid-year session. Remarkably, the draft Law amending and supplementing a number of articles of the Land Law will be considered by the National Assembly in 2019.

On June 8, Congress passed a resolution on the 2019 legislative program and the 2018 program.

According to the resolution, three law projects removed from the 2018 program are the Population Law, Urban Development Law, and Commune Police Law.

At the same time, the National Assembly approved the amendment of the People’s Public Security (Amendment) Law passed at its sixth session (late 2018).

Congress amend and supplement the Land Law in 2019

The Law on Tax Administration (amended) and the Law on Amendment of and Addition to a Number of Articles of the Law on Public Investment are all commented at the sixth session.

The Law on Amendment of and Additions to a Number of Articles of the Law on Judgment Execution of Criminal Judgment shall be removed from the comments at the 5th session to the 6th session.

The Law amending and supplementing a number of articles of the Law on Environmental Protection Taxes shall delay the giving of opinions at the 5 th session to the opinions of the 8th session.

About the legislative program in 2019 The National Assembly decides at its Seventh Session (May 2019) that the National Assembly will approve seven projects: the Public Administrative Law; Architecture Law; The Law on the Prevention and Fight Against the Harms of Alcohol and Beer; Law on Tax Administration (amended); The Law amending and supplementing a number of articles of the Law on Execution of Criminal Judgments; The Law on Amendment of and Addition to a Number of Articles of the Law on Public Investment; Resolution on the program of law and ordinance development in 2020.

In addition, nine of the draft law comments at this session included the Labor Code (amended); Law amending and supplementing some articles of the Land Law; The Law on Amendment of and Addition to a Number of Articles of the Law on Investment and the Law on Enterprises; Securities Law (amended) … these projects will be approved in the eighth session by the end of 2019.

Among the bills proposed to be passed at the 7th Session, the Law on Public Administration, headed by National Assembly Member Tran Thi Quoc Khanh drafting committee.

This is a very new sign in Vietnam’s legislative work as most of the bills are submitted by the Government and the minister is the head of the drafting committee.

Why revise the Land Law?

According to Ministry of Natural Resources and Environment, the implementation of the Land Law is still inadequate, such as access to land is still one of the barriers to improving the business investment environment, improving the capacity of the edge national paintings, business development support.

The use of land in many places is also wasteful, low efficiency; corruption, self-seeking and loss of land-related revenues still occurs; The accumulation of agricultural land is still slow, land fragmentation is a factor that hinders people and businesses long-term investment in agriculture.

In addition, many localities and units have been led by irresponsible leaders who have let their managers loose their land and use the land for improper purposes, Sign the change with the competent state agency, fail to strictly perform the financial obligations as prescribed.

Therefore, Ministry of Natural Resources and Environment proposed to continue amending and supplementing the Land Law 2013.
