Da Nang: Coastal Villa Projects Continue To Wrong

The Song project was prompted, punished many times for illegal construction but still bluntly executed, despite the law.

The Song project by the Corporation Development of tourism Viet (Khue My Ward, Ngu Hanh Son district, Da Nang) as an investor. The project is licensed by Da Nang Department of Construction No. 1270 / GPXD on August 10th.

Serious violation

Nguyen Thi Anh Thi, chairman of the People’s Committee of Ngu Hanh Son district, said that the report had been sent to the Secretary of the Provincial Party Committee regarding wrong handling at The Song.

Specifically, the renovated villa area in the licensed planning includes 19 three-storey villas with a total area of 5,008 sqm, an average area of 264 sqm/unit, but the status of the investor has been renovated to 20 villas, there is a large deviation from the approved plan with a total construction area of 6,975 sqm, an average area of 346 sqm/unit.

The Song is still under construction despite being fined several times

In the newly built villa area, under the planning of 18 three-story villas with a total area of 3,278 sqm, the average area of 182 sqm/unit. Status of 10 houses are building eight bases are clawing. Some apartments are located in a different position to the planning and have an area deviation from the approved plan. The total construction area of 10 units is 1.942sqm. The average area is 194.2sqm / unit.

Coastal bungalow (one-story house with roof) consists of seven two-storeyed buildings with a total area of 3,010 sqm. The average area is 459sqm / unit. The fourth basement is 260sqm. The current status of seven bungalows has an area of deviation from the approved plan. The total area increased to 3,307sqm. The average area is 478sqm / unit. Particularly, the number of four construction deviations from the planning, area 422sqm.

In addition, all bungalows have a balcony that stretches out to the public beach about 2.5m.

Disobeying the law

According to Nguyen Thi Anh Thi, on May 3, 2017, Hoa Hai Ward People’s Committee has checked the reality and worked with the investor proposed stop construction of works for the above violations.

On November 7, 2017, the Urban Management Department and the Urban Rules Inspection Division of Ngu Hanh Son District checked the reality, recognizing that the project was underway to renovate the coastal area, land, tree planting, grass planting.

The team asked the project owner to relocate, return the site starting from November 13 to November 30, 2017. On November 15, 2017, the Da Nang Construction Inspectorate also checked the project and made a written request to the investor to stop construction.

A series of construction violations were pointed out by the Ngu Hanh Son District People’s Committee

However, through the actual inspection, the investor still does not comply with that continue to execute the violation. Therefore, on November 27, 2017, the People’s Committee of Hoa Hai precinct issued a decision to force the investor to suspend the construction of infringing works and the procedures for obtaining permission according to regulations within 60 days. After the above time limit, if the investor fails to produce the construction permit, he/she shall dismantle it according to regulations.

On December 22, 2017, the People’s Committee of Ngu Hanh Son District issued a decision on fines of VND 100 million for wrongful acts involving aggravating circumstances. Remedial measures shall be the suspension of all construction activities and the procedures for adjusting and supplementing the permits as prescribed.

However, after successive decisions on sanctioning and suspension of construction, the investor of the Song project is having the opportunity to “legitimize” his wrong. Specifically, on January 18, if the owner can not submit the additional adjustment for the wrong construction items, the authorities will carry out coercive, destroying items that have been wrongly constructed.

 In addition, Nguyen Thi Anh Thi pointed out other projects in Ngu Hanh Son district with violations in construction such as Muong Thanh hotel complex and Son Tra high-class apartments; Dong Phuong villa and hotel project; The project of Sao Viet Non-Nuoc Resort. These projects are being applied by the authorities to suspend construction and wait for the next steps.
