Da Nang: Recommends transferring the police assigned to the children

On May 18, Da Nang Inspectorate announced the inspection of two resettlement projects and the Hoa Lien drainage channel (Hoa Lien commune, Hoa Vang district).

From July to 2017, the Da Nang Inspectorate set up an inter-branch inspection delegation under the direction of the City People’s Committee to inspect the observance of the policy on construction quality management for infrastructure projects: Hoa Lien 3 resettlement area, Hoa Lien 4 (phase 1 and 2), Hoa Lien flood drainage project.

The inspection concludes that Da Nang Construction Materials – Construction and Installation Company Limited (under the Department of Construction, the party calling for tenders) makes the designation of the contractor in contravention of the provisions for five supervision consultancy packages , construction contractor selection consultant with total value of more than VND 3.4 billion for Thuan Anh Trading and Services Co., Ltd by Mr. Nguyen Tuan Thanh as Director.

Nguyen Tuan Thanh is the son of Nguyen Tuan Anh (former General Director of Da Nang Construction Materials – Construction and Installation Company Limited).

The bid solicitor shall also perform the contractor appointment in excess of the prescribed limit for the package for construction and installation of the technical infrastructure of Hoa Lien 4 resettlement area (phase 1). Package price is over VND27.5 billion, while the limit is not more than VND5 billion.

Other bidding packages in the traffic and drainage basin … are also restricted by the party calling for tenders, even though they must be openly tendered in accordance with the Law on Procurement 2005.

Concerning this, the TP Inspectorate also pointed out that the current status of the above three resettlement projects was lower than the level under the approved design documents. Test positions vary is from 0.112m to 1.047m.

The cause of subsidence is mainly due to the failure of the parties to carry out geological survey work to ensure compliance with the regulations leading to the lack of bases, without calculating and proposing measures to deal with weak soil.

In the project of the drainage channel of Hoa Lien commune by the State Administration of Construction, Trung Nam Joint Stock Company is the investor in the form of BT (Build – Transfer), the State Inspectorate also pointed out many mistakes. These violations led to the project being delayed 16 months compared to the contract.

Recommendation to transfer the dossier to the investigation agency

Danang City Inspectorate concludes that, as the executing unit of the project (2010-2014 period), Da Nang Construction Materials – Construction and Installation Company Limited is directly responsible for the project to the above violations.

Pursuant to Point o, Clause 1, Article 48 of the Inspection Law 2010, the City Inspectorate shall propose to the City People’s Committee to transfer all case files related to offenses with criminal signs of organizations and individuals. On behalf of the Da Nang Public Security Investigation Agency, the case will be handled according to regulations.

Da Nang City Inspectorate proposes the City People’s Committee to review and handle the responsibility of the Department of Construction (the investor of the resettlement area project), Da Building Materials – Construction and Construction Company Limited Nang.

The Office of Da Nang People’s Committee was also asked to review and handle the responsibility of related departments and individuals in advising the issuance of the document approving the guidelines on appointment of bidders, regulations.

For the drainage channel of Hoa Lien Commune, the City Inspectorate recommends the City People’s Committee to direct the Department of Construction to review the responsibilities of the Institute of Construction Planning and the organizations and individuals involved in the implementation of the survey. The project does not adequately assess the difficulties and obstacles in the ground clearance work, the design drawings prolong the effect of the project.

The HCM City Inspectorate also recommended the City People’s Committee to direct the investor as Trung Nam Joint Stock Company to take measures to speed up the progress and complete the project on time.
