The Government Inspectorate has just given out conclusions about the inspection of many housing and residential area projects in Hanoi, including many violations in Kim Van – Kim Lu urban area project and CT2 land lot.
At present, Dien Bien No. 1 Private Construction Joint Stock Company (belonging to Muong Thanh Group of Mr. Le Thanh Than) and Construction Joint Stock Company Number 2 (Vinaconex 2) jointly exploit this land lot.
CT2 land lot was handed over by People’s Committee of Ho Chi Minh City from May 25, 2010 to Vinaconex 2. During the implementation, Vinaconex 2 signed a contract for technical infrastructure cooperation with Dien Bien No. 1 Private Construction Joint Stock Company on an area of 13,802 m2.
But according to the Government Inspectorate, to the inspection time, these two companies have not yet signed transfer contract with secondary investors for the construction of condominiums on this area and have not been licensed by the competent authorities yet.
“People’s Committee of the city has not determined payable land use fee yet, the Vinaconex 2 investor has not fulfilled its financial obligations. Pursuant to the investment cooperation contract, Dien Bien No. 1 Private Construction Joint Stock Company has invested to construct the building and stood its name to sell all 2,177 apartments to customers. Accordingly, Department of Natural Resources and Environment has issued a certificate of house ownership for customers, which violates the State regulations on land “the report stated.
The inspection team temporarily determines that the payable land use fee of CT2 lot is more than 733 billion VND, of which Vinaconex 2 and Dien Bien No. 1 Private Construction Joint Stock Company have to pay 392 billion VND.
On February 3, 2016, the Government Inspectorate issued a decision on temporary withdrawal to the custody temporary account the amount of 250 billion VND of Dien Bien No. 1 Private Construction Joint Stock Company. By March 8, 2016, this unit has paid 200 billion VND
Also according to the Government Inspectorate, Hanoi People’s Committee approved the master adjustment of the detailed planning of Kim Van – Kim Lu urban area, of which CT2 land lot has 45-storey building A, tower B 45- storey building B, 36-storey building D1 and 40-storey building D2 is not suitable with detailed construction plan of 1/2000 ratio (according to the 1/2000 ratio plan, average height of the land lot is 13 storeys while the average height of architectural space and landscape map is 20 storeys).
The Government Inspectorate stressed that the Department of Planning and Architecture advised the People’s Committee of Hanoi City to issue a decision approving the master adjustment of 1/500 detailed plan is not consistent with the detailed construction master plan of 1/2000 ratio and the construction density of 40.5% is not in accordance with construction standards.
The inspectorate concluded that Vinaconex 2 investor and Dien Bien No. 1 Private Construction Joint Stock Company has splitted the building into two separate buildings (D1 and D2) instead of building a five-storey block ground under the approved plan. In addition, they also build technical floor in D1 building with an area of 1,073 m2, build additional basement of 10,457 m2.
“Responsibility belongs to the Permanent People’s Committee of Hanoi and the departments of Natural Resources and Environment, Construction, Planning and Architecture, Taxation Bureau, Land Registration Office, project’s investors and other related parties”, according to the conclusion of the Government Inspectorate.
The Government Inspectorate has requested the Chairman of the People’s Committee of Hanoi to inspect, examine, resolve and return to land use fees of more than VND 480 billion for the city as the project’s investors have not fulfilled their obligations, of which Vinaconex 2 has to pay 340 billion dong and Dien Bien No. 1 Private Construction Joint Stock Company has to pay 142 billion dong.
