What is the waterway area?

What is heart wall area?

Heart wall is the way to measure the area measured from the heart of the wall. The heart wall area will include the wall of the house, the wall dividing the apartment, the floor area with columns, and the technical box inside the apartment. Reading here, people will think that using waterway area is better than heart wall area, but considering the possibility of exercising ownership and limiting disputes, selection of heart wall area is a more reasonable approach. Previously, when Circular 16/2010/TT-BXD was still in force, lawmakers allowed the investor the right to choose one of these two methods of calculating the area for application in the Purchase and Sale Agreement. This leads to a lot of troubles between the investor and the buyer because usually, the investor will choose the calculation method of hearing wall area, the reason is that this calculation will increase the actual area and reduce the price of the square meter of the apartment, create interesting psychology for buyers. The house buyer will get damages not only in terms of actually using area but also afterward service charges (calculated based on the area of the apartment in the contract).

Also for these reasons, at present, under the provisions of Section 2, Article 101 of the Housing Law 2014, the area of use of an apartment or another area in a condominium owned by the investor will be only calculated according to the waterway area. This calculation is the best way to ensure maximum benefit for house buyers both in terms of actually using area and area to charge for later apartment operation management services.

Specifically, Clause 2, Article 101, Housing Law No. 65/2014 / QH13, effective on July 1, 2015, area of use of the apartment is calculated according to the waterway area, including balcony area, loggia (if any), the wall area of the rooms inside the apartment and exclude the area of the house, the walls diving apartments, technical box area, the floor has columns inside the apartment. Under the provisions of Paragraph 3, Article 9, Housing Law No. 65/2014 / QH13, the competent authority issuing the pink book must clearly state in the pink book the type and level of housing in accordance with the provisions of the Housing Law and the regulation on construction; In the case of an apartment, use of the apartment and the construction floor area must be showed.
