The Hanoi People’s Committee assigned the Construction Department to apply the provisions of the Government’s Decree No. 53/2017 / ND-CP of May 8th, 2017 in the process of settling dossiers of application for construction permits falling under its competence.
Hanoi People’s Committee has issued Document No. 4208 / UBND-ĐT sent to the city departments; People’s committees of districts, townships on the implementation of Decree No. 53/2017 / ND-CP dated May 08th 2017 of the Government regulating the types of legal papers on land for construction permits.

Accordingly, the City People’s Committee assigns the Department of Construction to apply the provisions of Decree No. 53/2017 / ND-CP dated May 08th 2017 by the Government in the process of handling dossiers of application for construction permits under the right.
Assume the prime responsibility for, and coordinate with the Municipal Services, the People’s Committees of the urban and rural districts in, studying and submitting to the Hanoi People’s Committee for promulgation documents amending or replacing Decision No. 20/2016 / QD-UBND dated June 24th, 2016 of the People’s Committee of Hanoi, ensure compliance with the provisions of the Government’s Decree No. 53/2017 / ND-CP of May 8th, 2017, current legal documents and the actual situation of the city.

The Department of Natural Resources and Environment reviews and synthesizes legal documents and guiding documents of the City People’s Committee and the Department of Natural Resources and Environment on the identification of land-related legal papers related to the granting of construction permits until the effective date of Decree No. 53/2017 / ND-CP dated May 08th 2017 of the Government; Proposing, drafting and submitting to the City People’s Committee for cancellation, termination or validity of documents which are not compliant with Decree No. 53/2017 / NĐ-CP dated May 8th 2017 of the Government.
Presiding over the draft document approving the construction sites of district-level People’s Committees for construction of advertising boards, telecommunication stations and antenna posts in areas not used for construction and non-conversion of land use purpose; a form of land lease contract signed between the investor and the manager and use of transport works; a written approval of a competent state management agency in charge of traffic for works permitted to be built within the land area reserved for traffic; To send to the Department of Construction to compile a draft document detailing a number of contents on the issuance of construction permits in the city of Hanoi, and submit to the People’s Committee of Hanoi for promulgation.

People’s committees of districts, townships shall apply the provisions of the Government’s Decree No. 53/2017 / ND-CP dated May 8th, 2017 in the course of handling dossiers of application for construction permits falling under their competence.
Department of Information and Communication, Department of Transport, Department of Agriculture and Rural Development, Department of Finance, Department of Planning and Architecture in collaboration with Department of Natural Resources and Environment and construction licensing agencies in the city of Hanoi implement Decree 53/2017 / ND-CP dated May 8th, 2017 by the Government in accordance with its functions, tasks, and competence.
In the course of implementation, if any difficulty or problem falls beyond its settling competence, the concerned agencies, units, organizations or individuals shall have to propose to the provincial/municipal Construction Services for sum-up and report to the People’s Committees City to review and settle.
