(+84) 898 898 688On September 11, the People’s Committee of Thanh Tri district has conducted compulsory land recovery for 28 households deliberately not hand over the ground. In the total area of nearly 20,000 sqm of agricultural land to be recovered by 28 households in Tan Trieu commune, there are 12 households on the land, the rest is the land area of ponds, gardens and vacant land.
According to the People’s Committee of Thanh Tri district, on October 26, 2007, the People’s Committee of Hanoi decided to withdraw 357,910 sqm of land in Tan Trieu Commune to the Center for Land Development To arrange compensation, support and resettlement for ground preparation for the implementation of the project on construction of technical infrastructure of the entire land area of the South West Kim Giang I urban area, in service of construction resettlement house.
Then, on October 5, 2010, the People’s Committee of Hanoi decided to allocate land development center Thanh Tri district as investor to implement the project of ground clearance and leveling the urban area. according to the administrative boundaries of the district.
Vice chairman of the People’s Committee of Thanh Tri district Nguyen Tien Cuong said that based on the legal documents, the People’s Committee of the district has directed the relevant units to clear the site in accordance with the regulations. The policy of compensation and support is most beneficial to people who have land recovered.
Specifically, the district People’s Committee has issued a decision approving the compensation plan, supporting 369 households and individuals whose land and assets are within the clearance boundary; organized the project and paid for the households. However, some households and individuals still have not received money, handed over the ground to implement the project.
“It can be affirmed that the district has been in great demand, seriously organizing many meetings and exchanges with citizens, answering all complaints and complaints related to compensation policy. However, there are still many households deliberately oppose, not comply with the law, forcing districts and cities to take coercive measures to recover land, “Cuong said.
According to statistics, in 97 households have approved the plan but have not received money and handed over the land, the land is scattered in the plots of land that the city assigned to many different investors. Therefore, the coercion will not be implemented simultaneously but must follow the progress of each investor to ensure after the coercion units have to receive, manage the premises, avoid re-encroachment.
In the immediate future, according to the proposal of Thanh Xuan Bac Investment Limited Company, the district will carry out land clearance in each phase, of which phase 1 will be implemented in plots TT3, TT4, TT7A, Part of the route 2, 3, 14, 23. After review, only 28 households in the first phase suggested that the district People’s Committee issued the enforcement decision. Recalled 19,974.41 m2 of agricultural land.
Recognized during the forced land clearance on 11/9, some households have gathered to protest the decision of the district coercion, functional forces invited people to the People’s Committee of Tan Trieu explained. , convincing people to understand and strictly comply with the provisions of law.
Ms. Cao Thi Hau, Trieu Khuc village, Tan Trieu commune said that her family has more than 1,000 m2 of land allocated under Decree 64 also belong to the area recovered for the project. However, up to this point, the family has not received compensation for the reason why the same project that households receive the land for resettlement, many households are not being relocated?
“It is not fair to ask the commune and district leaders to dialogue with the people and to deal with the right people,” she said.
Explaining this, Deputy Director of the Center for Land Development in Thanh Tri district, Bui Huy Hoang, said that under the former regulations, Southwest Kim Giang 1 project is applied policy to support 60m2 residential land for households People over 30% of agricultural land. But since 2014, under the new Land Law 2013, the households are not supported by land but are supported by money (equal to 5 times the price of agricultural land under Decision 108/2009 / QD-UBND).
According to Mr. Hoang, at the time of 2013, soon after the city has Document No. 48 / TB-VP dated May 24, 2013 on creating favorable conditions for households who wish to apply will continue. According to the old mechanism and policy, the district issued the Notice No. 52 / TB-HDBTBTHT & TĐC dated 3 September 2009 requesting households to recover more than 30% of agricultural land without receiving land support at the project.
If they wish to receive residential land, they shall send their declarations and commitments to the commune People’s Committees by September 10, 2013 at the latest.
“This notice has been publicly posted at the commune People’s Committee, the Cultural House of Trieu Khuc village, read on the loudspeaker of the commune and sent a notice to each household and individual,” Hoang said.
Although very clear, public policy, but at that time, only 73 households have approved the plan to support job conversion and job creation by the allocation of 60m2 of land. For 82 non-co-ordinated households with no application, the district approved cash assistance.
Disagreement with the approval scheme, households constantly gathering large number of petitioners request for re-approval of land support policies. Facing this situation, the district has proposed to allow the city to continue applying the land allocation policy to households with more than 30% of agricultural land.
In response to this proposal, the Land Steering Committee of the City has clearly stated in Document No. 115 / BCĐ-NV3 dated March 15, 1818: “The Land Law 2013 will be effective from July 1, 2014 only regulates policies to support job change and job creation in money, no longer provides policy to support job conversion by land allocation to households with agricultural land.
Based on the above guidelines and the Land Law of 2013, leaders of Thanh Tri district met with households to announce the application of policies to support the change of occupation by land allocation for the households on the recovery. 30% of agricultural land is without foundation for implementation.
Evidence for this assertion is that at the time of April 5, 20117, some households filed a petition against district leaders that the district misrepresented the land clearance policies at the Court’s verdicts. People’s Committee of Hanoi concludes that the people’s demands for compensation, support to change jobs, create jobs by land service is inappropriate after the Land Law 2013 in effect.
According to reporters at the enforcement site on the morning of September 11, the forced eviction of land of 28 households has been implemented publicly and transparently according to the procedures prescribed by the State. , ensure absolute safety for force participation and ensure the stability of security situation in the area.
People’s Committee of Thanh Tri district said that after completion of land acquisition for these 28 households, from now until the end of the year, the district will continue to enforce land acquisition for the approved households but not yet. Receive money and hand over the premises. At the same time, the district also proposed that the city approve the resettlement site for eligible households to accelerate the project implementation.
