The People’s Committee of Ho Chi Minh City has just steered about publicizing list of projects that do not allow foreign organizations and individuals to own in the project.

Accordingly, the People’s Committee of the City requires the Department of Construction of the city to publicize the list of projects mentioned above to the portal of the Department. This will create a legal basis for the Department of Natural Resources and Environment to issue certificates of land use rights, ownership of houses and assets attached to land to foreign organizations and individuals.

In addition, the People’s Committee of Ho Chi Minh City also assigned the Department of Natural Resources and Environment to review the dossiers for granting certificates to foreign organizations and individuals buying houses in Ho Chi Minh City from July 01, 2015 until now.

With cases not eligible to grant certificates, the Natural Resources and Environment Department shall have to reply in detail and apologize for eligible cases but late settlement.

The City People’s Committee of HCM City also requests the Department of Natural Resources and Environment to recommend the measures to remedy the dossiers of foreign organizations and individuals buying houses in the city in the transition period from December 10, 2015 which had signed a sale contract in the Notary Public Office, had fulfilled its financial obligations to undertake when the state has regulations on the area where foreigners are not allowed to own.

It is known that the land registration office in Ho Chi Minh City has stopped issuing certificates of land use right, house ownership and assets attached to land for foreigners signing housing sale contracts after December 10, 2015 to wait for the decision from the Ministry of Defense and the Ministry of Public Security on the areas necessary to ensure security and defense under Decree No. 99/2015.
