What is your assessment of the implementation of compensation and resettlement policy in the city over time?

+ Mr. Tran Minh Tho: The view of leaders of the city is to ensure people living equal or better than the old place after the State of land recovery. However, before the legal regulations were not tight, the compensation, support, resettlement is not correct at market prices should actually have many inadequacies. Therefore, resettlement for the people is not as expected. Currently, when the legal regulations are increasingly tightened, the compensation, support and resettlement policies have also followed the market, thus ensuring both the rights of the people and the betterment of the State when land is taken to implement the project.

Decision 28/2018 on compensation, support and resettlement when the State recovers land in the area of ​​Ho Chi Minh City was issued on the basis of inheriting the policy of compensation, support and resettlement in Decision 23 / 2015 and supplement the new content from current legislation. At the same time, a very important factor is derived from the practical requirements of the city with the characteristics of a large city. There are legal issues that can not be specified, so it is necessary to have flexible application in order to fit the reality and create the agreement of the people. Thereby accelerating the compensation, clearance of projects.

What new issues do you think will make it easier for people who have land recovered?

According to Decision 28, for households with multiple generations, many couples live on the same parcel of land, if they meet the conditions for separation (in accordance with the Law on Residence) or there are many Households with the same right to use a parcel of land are considered to sell to each household a unit of resettlement in the apartment. If the project is only resettlement by land, the land shall be allocated but not more than the land area recovered.

Previously, in fact, in Ho Chi Minh City, there were many families living together in a land plot without separation, so only one household with resettlement policy was available for one household. However, according to the new regulations, in the case of a large number of households that have enough conditions to separate into many households, it will be settled for each household in that large family. This policy will be very suitable for suburban areas such as Cu Chi, Can Gio, Nha Be, Binh Chanh, Hoc Mon, where land funds for resettlement arrangements.

Decision 28 is also “generous” with an additional 5% if people receive their own accommodation. How is the specification?

+ For cases where people satisfying the conditions for resettlement but voluntarily refuse to receive residential land and / or resettlement housing but are self-relocated, they shall be entitled to 5% of the value of land compensation and support. For example, the total compensation, support is VND2 billion, the support is VND100 million.

In the past, people who received their own housing allowances were also supported, but they did not count on the investment in infrastructure. This is a new regulation, which is also an encouraging factor, creating a consensus of the people, while also reducing the pressure on the State to invest in resettlement housing. However, this does not mean that the state does not invest in resettlement funds. If people do not choose to pay for their own accommodation, the city always has a house fund to arrange resettlement.

Lengthen the time to hand over land to people in new housing

Previously when the land was recovered about 20 days, people have to hand over the ground to implement the project, if not assigned, will be subject to coercion. However, Decision 28 has relaxed the time of delivery is quite long, is this problem also comes from the practice?

That’s right. The process of compensation for a series of projects in the city, we find that the extension of the time to hand over the site is also a way for people to have the best time to prepare the place. Delivery time will vary depending on the type of land.

In urgent cases, what is the need for immediate deployment?

+ With this form, the handover time shall not exceed 30 days from the date of payment of compensation or support. Cases of eligibility for resettlement will be paid for rent or temporary accommodation. Payment period or temporary accommodation is one month after the date of handing over the site to the new home, six months in case of receiving the resettlement land and two months after receiving the apartment.
