The State Audit said the transfering of land use purposes to the implementation of investment projects by Vietnam National Chemical Corporation (Vinachem), Vietnam Tobacco Corporation (Vinataba) and Southern Food Corporation (Vinafood 2). There are many mistakes.

According to the State Audit, until the end of 2016, businesses have basically declared the status quo and changed the purpose of land use, but some still exist.

Specifically, the agency said that most of the units have converted land use purposes are not self-deploying projects associated with land use rights that contribute capital with external partners, then divest or commit to divest to transfer land to partners not through auctions.

However, all projects that designated investors for this company are not implemented but are being stopped or transferred to other investors (the project at 132 Ben Van Don has been transferred to the Company. Phat Dat Real Estate Development, project at 561 Kinh Duong Vuong has been transferred from November 25, 2014 to now having not been implemented).

According to the State Audit, the valuation of land rent right advantages is based on the method of self-implementation based on the negotiation and agreement among the parties, some cases have hired the price evaluation consultancy units but not yet have a reasonable basis for the reasonableness of the valuation should easily lead to loss of state property.

In addition, some cooperative units, joint ventures, capital contribution to establish a new legal entity, then change the purpose of land use to objects not belonging to state enterprises and not subject to relocation by the cell but do not conduct auctions of land use rights in accordance with the provisions of the law on land.

Some units contributed capital or delayed capital withdrawal in the field of real estate in accordance with Vinataba – Vinataba and Vinataba Thang Long – Vinataba – parent companies; Lix Detergent Joint Stock Company, Sao Vang Rubber Joint Stock Company, Southern Battery Battery Joint Stock Company, Hanoi Joint Stock Company belonging to Vinachem; Parent company – Vinafood 2 and Ho Chi Minh City under Vinafood 2.

The agency also said that these units hand over land to new legal entities without a decision of the competent authority. To transfer the project investor to other investors for houses and land managed by the Central Government without the approval of the Ministry of Finance or the Prime Minister.

Notably, Vinafood 2 has 6/7 land parcels (have been changed land use purpose) not used in 12 consecutive months but not yet the City People’s Committee. Ho Chi Minh City to recover land in accordance with the provisions of Clause 3, Article 1, Decision No. 140 / QD-TTg dated October 21, 2008.

In addition, Vinafood 2 has withdrawn the entire capital contributed by the value of assets on the land and the value of land lease rights, but still the name of the land lease contract at 561 Kinh Duong Vuong Street, An Lac Ward, District Binh.
