(+84) 898 898 688This is one of the innovations noted in the Circular amending Circular 09/2012 / TT-BXD (Circular 09) regulates the use of unbaked building materials in construction works which is completed by Ministry of Construction and prepared for issuance. Director of Construction Materials Department – Pham Van Bac confirmed.
The amendment was issued by the Ministry of Construction in Circular 09 in the context of the new use of VLXKN, has not studied the specific conditions of each region.

In the meantime, in fact, there are regions where conditions are well developed, whereas in regions with unfavorable conditions. Therefore, when Circular 09 is the most regulated in the whole country, the feasibility is not high.
On the other hand, the promotion of unbaked building materials in many localities is not strong, it is necessary to amend Circular 09 to suit the actual conditions and to encourage further development of unbaked building materials.
According to Director Pham Van Bac, this draft Circular has some new points. Especially, specifying the rate of use of unbaked building materials in construction works in each region in the whole country. In general, the rate of use of unbaked building materials in some areas is reduced compared to the provisions of Circular 09.
Regulations on the use of unbaked building materials for all construction works, including state capital works as well as non-budgetary works, also be adjusted in proportion.
Previously, Circular 09 did not stipulate the reporting regime for facilities using materials. Therefore, during the process of verification, it is not clear how the use of unbaked building materials in construction works in the area.
After the amendment, the new circular will stipulate for works using unbaked building materials must report data to the state management agencies in the locality every 6 months or 1 year. Based on that, the locality will gather and report to the Ministry of Construction.

Mr. Pham Van Bac said that the revised circular stipulates that local authorities and the Ministry of Construction periodically inspect and supervise. Processed breach is proposed in accordance with Decree 121/2014 / ND-CP (administrative sanctions in the field of construction).
Currently, the Ministry of Construction has completed the draft revision of Decree 121/2014 / ND-CP on sanctioning administrative violations in the field of construction; proposed fines are 1.5 to 2 times the current rate.
This draft is submitted to the Government for issuance. As such, sanctions will be more rigorous so that compliance with regulations on the use of unbaked building materials products is more effective in practice.
