Earlier, according to information from the agency CSZT (PC46), HCM City Police said after a period of investigation, October 25-2017, CSZT Police (PC46) Public Security issued decision Deceptive behavior on property appropriation for Kim Phat Real Estate Joint Stock Company and Viet Hung Phat Investment JSC for fraudulent acts in selling.

Viet Hung Phat Company’s Leaders still do not appear.

Specifically, both of these units have signed some contracts brokerage, transfer real estate projects in Dong Nai and Long An. During the sales transaction, Kim Phat and Viet Hung Phat have fraudulent acts in the process of organizing brokerage consulting and marketing real estate projects for customers to sign contracts.

In addition, instead of signing sales contracts in accordance with the law, the two companies have signed contracts to agree conditions for the transfer of land use rights, the agreement on conditions for contribution of construction the transfer of land use rights and the contract of agreement on conditions for capital contribution of land use right transfer.

All contracts are contrary to the contract brokers signed with the project investors. After that, Kim Phat and Viet Hung Phat have collected money, appropriating assets of customers. PC46 has decided to prosecute fraudulent criminal misappropriation of property. PC46 has summoned the relevant subjects to serve the investigation.

From the middle of 2016 to date, many customers have signed contracts to transfer land use rights with Kim Phat Company to purchase land in Dong Nai and Long An. However, Kim Phat changed the name of the project, raised the selling price of the land and signed with the customers the overlapping civil contracts to legalize the difference of VND80-300 million / platform.

Kim Phat said that he did not issue a receipt to the customer but only handed out a receipt. Similarly, according to the police investigation, Viet Hung Phat Company also signed a contract with customers to contribute capital to receive the transfer of land use rights for the project in Dong Nai. Although customers have transferred money, Viet Hung Phat does not transfer legal documents to customers.
