Although we very well aware of the concerns of the Ho Chi Minh City People’s Committee on minimum floor space requirements for apartments, but Ho Chi Minh City Real Estate Association (HoREA) said that for Ho Chi Minh City, it is possible to build small apartments with area from 25sqm to 45sqm in the outskirts and suburban districts.
It is necessary to ensure stable settlement for the people
According to Le Hoang Chau, President of HoREA, the Housing Law of 2014 has authorized the Government, Ministry of Construction and People’s Committees of provinces and cities under the central authority to decide on commercial housing design standards, social housing suits the needs and specific conditions of each locality.
For Ho Chi Minh City, housing demand for social housing, small commercial housing is 1-2 bedrooms, affordable price of public officials, public servants, rolling Armed forces, students, bachelors, young couples, workers and migrants are very large and need to be adequately dealt with in order to stabilize their settlements.
Therefore, HoREA suggested the Ministry of Construction to soon issue the “National Standards TCVN … on Housing – Fundamental principles for design” and “Construction Standards Vietnam Construction QCXDVN” to replace “National Standards TCVN 4451: 2012 on Housing – Fundamentals for Design” and “Vietnam Construction Standards Construction QCXDVN 01: 2008/BXD” including regulations on design standards of commercial apartment housing, social housing.
In addition, HoREA also proposed that the Ministry of Construction and the HCMC People’s Committee allow commercial housing condominiums with an area of at least 25sqm floor, but must be consistent with detailed construction planning and standards, construction standards, housing architecture and contents of investment policy of the project of housing construction of competent state agencies.
“The association recommends that the minimum floor area of 25sqm to less than 45sqm of floor space should not exceed 25-30% of the total number of apartments. In particular, for Ho Chi Minh City, the association suggested that it would be possible to build small type apartments ranging in size from 25m2 floor to less than 45m2 floor in suburban districts are more appropriate” HoREA said.

According to Le Hoang Chau, based on the 2005 Housing Law, the Ministry of Construction has issued the “National Standard TCVN 4451: 2012 on Housing – Fundamental Principles for Design” commercial housing regulations are not lower than 45sqm, social housing apartments from the 30-60sqm floor.
On June 23, 2010, the Government issued Decree 71 detailing and guiding the implementation of the Housing Law. It is worth mentioning, there is the Construction Law 2014, Housing Law 2014, Decree 100/2015/ND-CP, but the Ministry of Construction has not yet issued a new set of ” Basic Rules for Design “to replace” National Standard TCVN 4451: 2012 on Housing – Fundamental Principles for Design “and” Vietnam Construction Standards Construction QCXDVN 01: 2008/BXD ” was issued by the Ministry of Construction in Decision No. 04/2008/QD-BXD dated April 3, 2008.
In fact, there has been incompatibility of the legal system of construction and housing. Specifically, the “National Standard TCVN 4451: 2012 on Housing – Fundamental principles for design” is still in effect, still stipulates commercial apartments with minimum floor area of 45sqm floor , while the Housing Act 2014 stipulates “the type of housing, standard area of each type of commercial housing selected by the project investor but must be consistent with detailed construction planning, construction standards, housing architecture and the contents of the investment policy of the project on construction of dwelling houses of competent state agencies”.
Previously, on 11/9/2017 People’s Committee of Ho Chi Minh City has written to the Ministry of Construction with recommendations: For social housing projects, the standard area of social housing based on the provisions of the Decree No. 100 by the Government. For commercial housing projects, pending the promulgation of new national technical standards on condominiums, the standard of commercial housing area shall comply with the provisions of Vietnam National Standard TCVN 4451: 2012 on Housing – Fundamentals for Design, as stated above”.
The above recommendations of HoREA are clearly expressed in the letter No. 100 sent to the Ministry of Construction, the Standing Committee of Ho Chi Minh City Party Committee, Standing People’s Council of Ho Chi Minh City, Standing People’s Committee of Ho Chi Minh City and department of Construction Ho Chi Minh City on 12/9/2017. However, the above recommendations whether to be accepted or not will have to wait.
