Red Book Separation Procedure


Question:

I bought a piece of land with a total area  94 sqm in a land area of 194 sqm. When the general book, my area is only 44 sqm residential land, the rest 50 sqm of the road and the planning of the project adjacent. So how does red book split procedure?

Assuming your land area in Ho Chi Minh City, the red book will be separated by the Ho Chi Minh City People’s Committee’s Decision No. 33/2014 / QD-UBND dated 15 October 2014. The area of newly formed land and the remaining land, after subtracting the boundary, the minimum area at:

Area  1 (Districts 1, 3, 4, 5, 6, 8, 10, 11, Go Vap, Binh Thanh, Phu Nhuan, Tan Binh and Tan Phu) is 50 sqm and the width of the land plot is not less than 04 meters (unoccupied land) and 45 sqm. Ground width of the parcel of land shall not be less than 03 meters in the street with a width of 20 meters; 36 sqm and the width of the front of the parcel of land shall not be less than 03 meters in the street with a width of fewer than 20 meters (existing residential land);

Area 2 (Districts 2, 7, 9, 12, Binh Tan, Thu Duc and urban districts are urbanized) is 80 sqm and the width of the land plot is not less than 05 meters Have a house);  50 sqm and the width of the front of the land plot is not less than 04 meters (residential land has existing houses);

Area 3 (including Binh Chanh, Cu Chi, Hoc Mon, Nha Be and Can Gio districts, except for the town or urbanized area of the district) is 120 sqm and the width of the land plot is not less than 07 meters (unoccupied land); and 80 sqm and the width of the front of the parcel of land is not less than 05 meters (residential land has existing housing).

With regard to the separation procedure, you file one set of the application file, including the application for land separation (from No. 11 / ĐK) and the original certificate to the Land Registration Office. The time for carrying out the separation procedure shall not exceed 20 days from the date of receipt of a complete and valid file.
