What Is The Difference Between The Pink Book And Red Book?


In fact, pink book and red book are just familiar names that people set themselves based on the color of each paper so that they can easily distinguish between types of certificates. The difference between the red book and the pink book can be considered as follows:

The Red Book is a form issued by the Ministry of Natural Resources and Environment, with a red cover with the content of land use rights (possibly residential land, agricultural land, gardens, ponds, forest land …). This form is called “Land Use Right Certificate”.

According to the regulation of Clause 20 of Article 4 of the 2003 Land Law, “the land use right certificate is a certificate issued by a competent state agency to a land user to protect the legitimate rights and interests of the land user.”

Difference between red book and pink book

At the same time, a pink book is a form issued by the Ministry of Construction, the cover is pink with the content of residential ownership and land ownership, so the form is called “Certificate of ownership housing and land use rights “.

Under the Article 11 of the 2005 Housing Law, certificates of ownership accommodation are granted to owners according to the following regulations:

a / If the house’s owner is concurrently the owner of the residential land or the owner of the apartment, you will be issued a certificate of house ownership and land use rights

  1. b) In cases that the house’s owner is not concurrently the land user, the house’s ownership certificate shall be granted. Certificates of house ownership and land use right is referred to collectively as the certificate of house ownership.

However, in order to unify a type of certificate, on October 19th, 2009, the Government issued Decree No. 88/2009 / ND-CP and on October 21st, 2009, the Ministry of Natural Resources and Environment issued the Circular No. 17/2009 / TT-BTNMT on grant of land use right certificates, house ownership and other assets attached to land. Accordingly, these two types of certificates will be issued by the Ministry of Natural Resources and Environment according to a unified form and applied throughout the country for all types of land, houses and other assets attached to land. …

Inheriting the above regulation, Article 97 of the Land Law 2013 also provides:

1.Certificates of land use rights, house ownership and other assets attached to land shall be granted to persons having land use rights, house ownership and ownership of other assets attached to land under a unified form throughout the country. The Minister of Natural Resources and Environment shall specify the certificate of land use right, house ownership and other assets attached to land.

  1. Certificate of land use right, house ownership, and land use right certificate, house ownership certificate or construction work ownership certificate is granted under regulations of the land law, housing law, construction law before December 10th , 2009 which is still valid and does not have to change to the certificate of land use rights, house ownership and other assets attached to land. A person has been granted a certificate before December 10th, 2009, can change it to a certificate of land use right, house ownership and other assets attached to land in accordance with the provisions of this law “.

So, according to the regulations,  red book or pink book are all certificates of land use rights or house ownership issued by competent state agencies. In practice, there are currently 3 types of documents in circulation: land use right certificate, house ownership certificate and land use right certificate, house ownership and other property attached to land. All three have the same legal value.
