Mr. Tran Son Hai, Standing Vice Chairman of Khanh Hoa People’s Committee has recently sent a letter to the Department of Planning and Investment, Department of Tourism, Department of Justice and Management Board of Cam Ranh Peninsula Resort directs on holiday ownership contracts and the ALMA project of Paradise Bay Co., Ltd.
Accordingly, the PPC assigns the Department of Planning and Investment preside and coordinate with Management Board of Cam Ranh peninsula tourist resort to inspect and guide investors to implement the project in accordance with the Investment Certificate and Concluding Notice No. 65 dated 3/3/2016 of the People’s Committee The province is committed to the progress of the ALMA project in the North Cam Ranh tourist area. If this project continues to be violated, it shall handle according to its competence or advise the provincial People’s Committee to handle it according to regulations.
In addition, the provincial People’s Committee also assigned the Department of Tourism to coordinate with the Department of Justice, the Department of Industry and Trade, the Department of Information and Communications, the Lawyers’ Association, the Association of Consumer Protection and other branches and localities. Involve working directly with Paradise Bay Co., Ltd. on the content of the holiday ownership contract to rectify and correct wrongdoings (if any), at the same time, information should be widely advised to the public, should consult specialized agencies and lawyer’s organizations before signing to avoid damage and risk.
Accordingly, on August 28, at the headquarters of the Justice Department of Khanh Hoa province, a working session on issues related to the ALMA project was held. The meeting was held on the basis of the petition to inspect and inspect the ALMA project to the Khanh Hoa People’s Committee of Truong Anh Tu Law Firm.
The Department of Justice of Khanh Hoa province chaired the meeting under the direction of the provincial People’s Committee. There are also representatives from the Department of Planning and Investment, Department of Tourism, Khanh Hoa Consumer Protection Association, Department of Information and Communication, Department of Construction….Especially, there is the presence of the representative of Thien Duong Company and representative of Truong Anh Tu lawyer.
At this meeting, the main content discussed by the parties was about the legitimacy of the ALMA Company’s “vacation ownership” as well as mistakes in the areas of specialized state management.
Also at the meeting, the Department of Justice asked the ALMA representative to clarify the issues: how many contracts have been signed before the license (the license to build each item, before the last permit, how many items are constructed, have the construction as the license is granted or not).
How many apartments are qualified to provide services to customers under the signed contracts; How many customers are using the service when signing the contract, after contract customers are kept 1 copy under the agreement or not? With the current construction progress, the company must demonstrate the financial capacity, the ability to mobilize resources to ensure that by the end of 2018, there will be 200-400 apartments qualified for customers.
Prior to this request, the ALMA requested to send a detailed written reply to the relevant departments. Regarding the progress of the project, the legal representative of ALMA stated that the project still ensures progress and that by the end of 2018 it will complete the project investment.
At the same time, reserve the view that all their activities in selling “vacation property” are in compliance with the law. However, before the analyzes of representatives of the Department of Justice at the meeting, ALMA acknowledged that no apartment has been formed.
According to the Department of Justice, “Vacation ownership” is a new name, a new concept but the nature of which is conditional service provision, is conditional service providers must meet the conditions (there are apartments qualified under the agreement in the contract to provide services to customers, payment in any form…).
So, although ALMA has no apartment, villa that formed but signed a holiday ownership contract with the customer, this means that the company sells the service when not qualified. In addition to the commitment of the investor, there is no guarantee that by the end of 2018 this project will have enough apartments to supply to customers.
It is known that after the meeting on 28/8, issues discussed and discussed at the meeting of the participants will be compiled into a document sent to the People’s Committee of Khanh Hoa. The representative of the Department of Justice requests departments to provide written the clarification on issues that the Department of Justice asked the parties and comments in the meeting before September 10.
Earlier, according to a reporter, on August 17, the Khanh Hoa Tourism Department also chaired a meeting related to ALMA project issues.
Talking to reporters, lawyer Tran Duc Phuong – who attended the workshop of ALMA organization said: ALMA is the deliberately misleading customer is a project located in Nha Trang city.
However, Khanh Hoa province has two cities, Nha Trang City and Cam Ranh City, and there are also two places called 2 airports. Therefore, ALMA staff when introducing the project easily equates. At the workshop, the staff said the project was 8km from Nha Trang Airport or said the resort in Ho Chi Minh City. Nha Trang (in all their advertisements dodge the word Cam Ranh city).
Even in the press release of 3/8/2012 ALMA also recorded the project located in Nha Trang city.
Just with this cheat is enough for the customer to request a cancellation. Not to mention, according to the introduction model of ALMA, the building will be built in W, and have a curve, but now they are building two V, unlike previous introductions that ALMA employees tell customers.
